Terms of Use

Please read these terms carefully before using the 3D QR Menü platform.

1. Effect and Acceptance

These Terms of Use ("Terms") govern the legal relationship between the user and the 3D QR Menü Development Team ("Development Team"), which operates the 3D QR Menü ("Platform") services. By creating an account on the Platform, purchasing a subscription or using the services in any way, you declare that you have read, understood and accepted these Terms.

Persons who do not comply with the Terms may not use the Platform. To open a Platform account you must be at least 18 years old and have the legal capacity to transact under the laws of the Republic of Türkiye. Provisions on the processing of your personal data are set out in our Privacy Policy and KVKK Information Notice; these form an integral part of the Terms.

2. Definition of the Service

3D QR Menü is a cloud-based SaaS (Software as a Service) platform that provides a digital QR menu infrastructure with 3D and augmented reality (AR) support for restaurants, cafés, bars and similar businesses. The Platform includes the digital menu, online ordering, reservations, table management, inventory tracking, campaign management, staff scheduling and financial reporting modules.

Modules may be subscribed to partly separately; the modules you purchase are enabled in your business panel. When a module subscription ends, the functions related to that module are disabled; other parts of your menu and core data are not lost.

3. Creating an Account and Security

  • You warrant that the information you provide during registration is accurate, current and complete.
  • You are responsible for the security of your account and password; you must not share your password with third parties. If your account is subject to unauthorised use, notify the Development Team immediately.
  • If you use the Google sign-in feature, the security and access conditions of your Google account are governed by Google's own terms.
  • The Development Team reserves the right to temporarily suspend an account in case of suspected or unlawful use.

4. Subscription, Fees and Payment

  • Module and plan fees, scopes and periods are stated on the relevant purchase page. Fees are the amounts valid at the time of payment.
  • Payments are made by credit or debit card through our payment provider PayTR. Your card details are not stored on the Development Team's systems; verification, collection and refund transactions are carried out by PayTR.
  • Your invoice is issued based on the billing details you provided at registration and sent by email. The user is responsible for the accuracy of the billing details.
  • Coupons and discounts are subject to the conditions in their definitions; different campaigns cannot be combined.
  • The Development Team may change prices and plan scopes; new fees apply only to new purchases made after the change. The fee of your ongoing subscription period does not change.
  • Under the distance selling regulations, your statutory withdrawal and refund rights apply within the framework of the legislation and the payment provider's rules.

5. Rules of Use

By using the Platform you agree not to engage in the following:

  • Publishing any content that is unlawful, contrary to public order or general morality; obscene, contains hate speech, or infringes third-party rights (copyright, trademark, personal data, privacy).
  • Attempting to gain unauthorised access to the Platform's software, source code or technical infrastructure; reverse engineering the system, extracting data with automated tools, or using the Platform outside its intended purpose.
  • Sharing accounts, transferring or selling accounts to third parties; using the same account for multiple businesses beyond the scope of the subscription plan.
  • Making unauthorised access attempts, trying to break PIN codes or passwords, circumventing rate-limiting measures, or disrupting the operation of the Platform.
  • Deliberately abusing the QR menu order, reservation or review features, or maliciously blocking the operations of businesses.

6. Your Obligations as a Business

  • You are responsible for the product names, prices, images, descriptions and advertisements you add to your QR menu and business panel, and for their compliance with consumer legislation, food safety and labelling regulations (including allergen disclosure).
  • Keeping menu prices, stock and product information up to date is your responsibility; the Platform is merely a display tool.
  • For customer and staff data collected through your QR menu, the data controller is your business; you carry out the KVKK information and, where applicable, explicit consent obligations towards your customers and staff. The Development Team processes this data only upon your instruction, in the capacity of data processor.
  • The sale of age-restricted products (alcohol, etc.) must be made only to the extent and in the manner permitted by applicable law.

7. Intellectual Property Rights

The Platform's software, design, logo, infrastructure, brand names and menu templates belong to the Development Team and are protected under intellectual property law.

All rights to the content you create — including the product images, descriptions and your business logo you upload — belong to you. By publishing this content on the Platform, you grant the Development Team a limited, revocable, non-exclusive licence to host, display, back up and use the content to the extent necessary to provide the service to you. This licence ends when you remove the content from the Platform.

8. Service Operation, Maintenance and Access

  • The Platform is provided "as is"; no warranty is given that it will operate without interruption or errors.
  • The Development Team may carry out technical improvements and maintenance; temporary access restrictions may occur during these works. An effective maintenance window is announced in advance whenever possible.
  • The Development Team hosts your data with a cloud provider (Firebase) that processes data on enterprise infrastructure; however, you are advised to take care to back up your important business data (menu contents, prices, reports).
  • The Development Team may add new features or change low-usage features; the operation of the core service is preserved.

9. Third-Party Services

The Platform uses third-party services such as Google (Firebase, Analytics, reCAPTCHA), PayTR (payments) and Hostinger (email). These services are subject to their own terms of use and privacy policies. The Development Team's liability for access losses arising from failures of these providers is limited by Article 10 of these Terms.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The Development Team shall not be liable for loss of profit, business interruption, data loss, or indirect, direct, incidental or consequential damages.
  • The Development Team's total liability is limited to the subscription fee collected from the user for the period related to the damaging event.
  • Intent, gross negligence, death or injury and mandatory provisions of law are reserved.
  • The user agrees to compensate the Development Team for damages and expenses arising from claims made by third parties in connection with the user's use of the Platform.

11. Termination and Account Closure

  • You can permanently delete your account at any time via Settings → Delete My Account. This permanently removes your business data, all subcollections (menu, orders, reservations, inventory, staff, finance, campaigns), all uploaded images and your user account. Tax records subject to legal retention (Tax Procedure Law Art.10) and system activity logs are retained. This action cannot be undone.
  • You may end your subscription at any time by not renewing it, and may request the closure of your account. Closing the account may not result in any refund for the paid period; your statutory refund rights are reserved.
  • If you breach the Terms, the Development Team may, depending on the nature of the breach, remove your content, suspend or permanently close your account, and notify the competent authorities where it deems necessary.
  • After termination, your data is processed in accordance with the retention and deletion provisions of the Privacy Policy.

12. Changes to the Terms

The Development Team may update these Terms from time to time. The updated text takes effect as soon as it is published on this page. Continuing to use the Platform after publication means you accept the updated Terms. For significant changes, you will be notified by email or an in-Platform notice.

13. Governing Law, Jurisdiction and Miscellaneous

  • These Terms are governed by the laws of the Republic of Türkiye.
  • The Courts and Enforcement Offices of Ankara (Türkiye) have jurisdiction over disputes arising from these Terms.
  • The invalidity of any provision does not affect the validity of the other provisions.
  • Mandatory provisions of the applicable legislation (in particular consumer law) always prevail over these Terms.
